This Privacy Policy describes how Hi-Rez Studios, Inc. (“Hi-Rez,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information. Service Usage DataWhen you play our games, we may collect information about your hardware system, gameplay and how our games are used, including, without limitation, your IP address, your gameplay characteristics and patterns, information about your computer, hardware, software, platform, media, information about online activity (e.g., feature usage), gameplay statistics and scores, user rankings, and click paths and other data that you may provide in surveys or online profiles.We have a legitimate interest in allowing our users to play our games over the Internet. SurveysWhen you participate in a survey, we collect information that you provide through the survey. We may also use this information to select and direct advertising that is more likely to be of interest to you.
Sweepstakes or ContestsWhen you participate in a sweepstakes or contest, we collect information about you which includes contact information to notify you if you are selected.We have a legitimate interest in operating the sweepstakes. In some contexts, we are also required by law to collect information about those that enter into our sweepstakes, and we have a legitimate interest in complying with those laws.
Tournament and Online Game DataWhen you participate in tournaments or other online game events we collect and publicly display performance and statistical data (e.g., your scores, rankings, and achievements) generated through your participation in the foregoing. Prize winners may also be required to provide Social Security or Social Identification Numbers for tax purposes.We have a legitimate interest in conducting tournaments and allowing our users to participate in online game events. Among other things, it helps us understand which of our services is the most popular.

How We Use Information

In addition to the purposes and uses described above, we use information in the following ways:

  • To: (a) comply with legal or regulatory process (such as a judicial proceeding, court order, or government inquiry) or obligations that we may owe pursuant to ethical and other professional rules, laws, and regulations; (b) enforce our Terms of Service and other policies; (c) respond to claims that any content violates the rights of third parties; (d) to establish or exercise our rights; (to defend against a legal claim; or (e) protect the rights, property, or personal safety of Hi-Rez, its employees, its users, its clients, and the public.
  • For internal administrative purposes, as well as to manage our relationships.
  • For such other purposes as you may consent (from time to time).

Although the sections above describe our primary purpose in collecting your information, in many situations we have more than one purpose. For example, when you create an account with us, we will collect your information to perform our contract with you, but we also collect your information as we have a legitimate interest in giving our users the best experience possible while playing our games. As a result, our collection and processing of your information is based in different contexts upon your consent, our need to perform a contract, our obligations under law, and/or our legitimate interest in conducting our business.

To the extent we maintain and use personal information in a deidentified form, we will not attempt to reidentify the information, except for the purpose of determining whether our deidentification processes satisfy our legal obligations.

How We Share Information

In addition to the specific situations discussed elsewhere in this Privacy Policy, we may disclose personal information in the following situations:

 

  • Affiliates and Acquisitions. We may share information with our corporate affiliates (g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company, including at the negotiation stage.
  • Public. Some of our websites may provide the opportunity to post comments, or reviews, in a public forum. If you decide to submit information on these pages, that information may be publicly available.
  • Partner Promotion. Users who register for an account with Hi-Rez may register for other third-party partners from our Site or link a Hi-Rez account to an account with such third-party partners, from time to time. If you opt-in to any of these services, we may collect additional information including, without limitation, information requested by a third party, and pass this information, together with all other personal information, to that third party partner. Use of your personal information by a third-party partner will be governed by that third party partner’s privacy policy. We may also retain any additional information collected for use in accordance with the terms of this Policy. Participation in these other related services is optional and is not required to access our Site, though some functionality may depend upon it.
  • Service Providers. We share your information with service providers. Among other things service providers may help us to administer our Sites and Services, conduct surveys, provide technical support, aid in auditing practices, process payments on the Site, and for other legitimate purposes permitted by applicable law.
  • Targeted Advertising. We share certain information – including your contact information, service data, web logs, website interactions, purchase and registration data, and cookie data – with behavioral advertisers in order to provide you with more relevant advertisements and product offerings.
  • Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws.   • Other Disclosures with Your Consent. We may disclose your information to other third parties when we have your consent or direction to do so.

Your Privacy Rights and Choices

Depending on where you reside, you may have the right under applicable law to make the following choices regarding your personal information:

  • Access To Your Personal Information. You may request access to your personal information or confirmation that we have information about you. In certain limited circumstances, you may also request to receive access to your data in a portable, machine-readable format.
  • Changes To Your Personal Information. You may edit some of your personal information through your account or ask us to change, update, or fix your personal information in certain cases, including if it is inaccurate. When you update your account information, we may keep a copy of your previous account details for our records and to prevent fraud or other activities that violate our terms, policies, and agreements.
  • Deletion Of Your Personal Information. You may request that we delete your personal information. If required by law, we will grant a request to delete information, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purposes.
  • Opt-out of Targeted Advertising/Sharing. You may opt-out of the processing of your personal information for targeted advertising/ sharing for purposes of cross-context behavioral advertising. You may opt-out of online tracking based targeted advertising (e.g., cookies) by clicking the “Manage Cookies” link in the footer of our Sites. Please note that if you change browsers or computers, or if you clear your browser’s cache, you may need to click the link again to apply your preference. You may also opt-out of other forms of targeted advertising by submitting a request as described below.
  • Restrict/Object to Certain Processing. You may object to the processing of your personal information or ask us to restrict the processing of your personal information under certain circumstances.
  • Revocation Of Consent. Where we process your personal information based upon consent, you may revoke consent. If you revoke your consent for the processing of personal information, then we may no longer be able to provide you services.
  • Online Tracking. We do not currently recognize the “Do Not Track” signal.
  • Communication Preferences. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, event invitations, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in emails that you receive. If you decide not to receive promotional emails, we may still send you service-related communications.
  • Promotional Text Messages. If you receive a text message from us that contains promotional information you can opt-out of receiving future text messages by replying “STOP.”

Please note, not all of the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity. We will not discriminate against individuals who exercise their privacy rights under applicable law.

Submitting Requests

You may exercise the rights described above by submitting a ticket through our support desk at Submit a Support Ticket ; or email [email protected]. Note that, as required by law, we will require you to prove your identity. When you submit your request, we ask that you provide reasonable details such that we can identify you and verify the authenticity of your request. We may conduct additional verification by phone call or email, as needed. Depending on your request, we will ask for information such as your account username (not in game name), the email originally used to create your account, any receipts for real money purchase, and other information we may have on file for you. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete personal information about you in our files.

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. If you choose to use an authorized agent, we require that you provide the authorized agent with written permission to allow them to submit your request and that you verify your identity directly with us. If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of a completed Authorized Agent Designation Form indicating that you are able to act on another person’s behalf.

If we deny or fail to take action on your request, you may appeal our decision. To do this, you may email us at [email protected] with the subject line “Appeal.” In the email appeal, please specify the right(s) you requested to exercise and the date you made such a request.

How We Protect Information

No method of transmission over the internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Some of our Sites and Services permit you to create an account. When you do you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.

How Long We Retain Information

We retain your personal information for only as long as necessary to fulfil the purposes outlined in this Privacy Policy, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required or permitted by law. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we obtained the information and whether we can achieve those purposes through other means, as well as applicable legal requirements.

Transmission Of Information To Other Countries

Hi-Rez maintains and stores your information on servers located within the United States, and we engage service providers who may process your information outside of the United States. As a result, your information may be processed in a foreign country where privacy laws may be less stringent than the laws in your country. Nonetheless, where possible we take steps to treat personal information using the same privacy principles that apply pursuant to the law of the country in which we first received your information. By submitting your personal information to us you agree to the transfer, storage, and processing of your information in a country other than your country of residence including, but not necessarily limited to, the United States. If you would like more information concerning our attempts to apply the privacy principles applicable in one jurisdiction to data when it goes to another jurisdiction you can contact us using the contact information below. You may also request a copy of any Standard Contractual Clauses we use for the transfer of your data outside of the EEA, which includes the categories of information transferred by contacting us using the contact information below.

Third-Party Applications/Websites

You may find links to third party websites, payment applications, and widgets on our Sites or Services that we do not own nor control. When you interact with such links or applications, you may leave the Hi-Rez Site you are visiting and go to the website you selected. For example, you may be required to establish a STEAM account with Valve Corporation to use our game(s), and you may be required to provide credit card and other information to Valve Corporation and our other third-party payment processors when you purchase products or services from our Site or through our Service. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements, which should be available at the time that these third parties collect your information. Once you leave our Site/Service or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Site’s Terms of Service.

The Site may also offer you the ability to share your information through a social networking site (e.g., Facebook, Twitter, LinkedIn), using such social networking site’s integrated tools (e.g., Facebook “Like” button, or Twitter “Tweet” button). The use of such integrated tools enables you to share information about yourself with other individuals or the public, depending on the settings that you have established with such social networking site. Additionally, by making information available on the Site or Service, you “opt in” to allow Hi-Rez to provide such Personal Information to a social networking site without your further consent. Changes To This Privacy Policy

We may change our privacy policy and practices over time. To the extent that our policy changes in a material way, the policy that was in place at the time that you submitted personal information to us will generally govern that information unless we receive your consent to the new privacy policy. Children’s Privacy

Our Sites and Services are not intended for children under the age of 13 and we do not knowingly collect personal information from children under age 13, without parental consent. Children under the age of 13 should not provide their personal information to us.

  • California Shine the Light. If you would like more information concerning the categories of personal information (if any) we share with third parties or affiliates for those parties to use for direct marketing, please submit a written request to us using the information in the Contact Information section above.
  • California Notice of Financial Incentive. From time to time, we may provide exclusive offers when you sign up for our email newsletters (the “Loyalty Program”). When you sign up for a Loyalty Program, we will ask you to provide your email address. Under California law, our Loyalty Program might be interpreted a “financial incentive” program as it involves the collection of personal information. We do not assign a monetary value to the information we collect. Based on our reasonable estimate, the value of your personal information to us is related to the value of the free or discounted products or services that you obtain through the Loyalty Program. This value is based on the expense related to offering those free or discounted products or services. You may withdraw from participating in the Loyalty Programs at any time by contacting us using the information in the Contact Information section above.
  • Categories of Personal Information Collected and Disclosed. California law indicates that organizations must disclose the categories of personal information they collect, disclose for a “business purpose,” and/or “share” for purposes of cross-context behavioral advertising (as those terms are defined by California law).   • California Sensitive Information Disclosure. Some of the personal information we collect is considered “sensitive personal information” under California law. In rare circumstances, we collect government identification information in order to comply with laws when paying out tournament and game winners. We also collect account login and password information from our users in order to ensure the security and integrity of our Sites and Services. Note that we do not use such information for any purposes that are not identified within the Cal. Civ. Code Section 1798.121. We do not “sell” or “share” sensitive personal information for purposes of cross-context behavioral advertising.
